By accessing our Site or placing an order, you agree to be bound by these Terms. Please read them carefully, as they outline both your rights and responsibilities, and our commitment to you.

Our shop is designed for gardening enthusiasts, from those starting their first potted colour display to seasoned cultivators of feature trees and native gardens. We aim to provide a transparent, trustworthy, and nurturing experience from browsing to blooming.

1. Our Relationship: Understanding Each Other

These Terms form a contract between you, the customer (“you”), and The Planters Shop (“we,” “us,” or “our”). Our business is located at 85 Gaffney Street, NORTH GEELONG, VIC 3215, Australia.

2. Product & Service Description

We specialise in providing a wide range of living plants and gardening products, including but not limited to:

• Feature Trees, Standard & Topiary: Larger, statement plants that may be made-to-order.
• Cottage Perennials, Annuals & Potted Colour: Seasonal and flowering plants.
• Fruits & Vegetables, Bushes & Shrubs, Climbers, Roses: Productive and ornamental varieties.
• Natives & Indigenous, Grasses & Flaxes, Conifers & Pines: Plants suited to specific environments.
• Indoors & Houseplants, Succulents & Cacti: Plants for interior spaces.

We strive for accurate photographic and descriptive representation. However, as living organisms, plants vary in size, shape, and exact colour. Seasonal availability affects stock. We reserve the right to correct any errors and to update product information at any time.

3. Orders & Payment Terms

Placing an Order

Order placement constitutes an offer to purchase. We confirm acceptance by sending an order confirmation email. All orders are subject to availability and our acceptance.

Pricing & Payment

Prices are in Australian Dollars (AUD) and include GST where applicable. We reserve the right to change prices. The price charged is the price valid at the time your order is placed.

Accepted Payment Methods: Visa, MasterCard, JCB, and PayPal. Payment is processed securely at the time of order. You represent that you are authorised to use your chosen payment method.

Shipping & Delivery

• Order Processing: 1-2 business days before dispatch.
• Standard Shipping: A$12.95 via DHL or FedEx. Estimated delivery: 10-15 business days post-dispatch.
• Free Shipping: Automatically applied to orders over A$50, shipped via EMS. Estimated delivery: 15-25 business days post-dispatch.

Shipping Limitations: We cannot ship to some parts of Asia and select remote regions. You are responsible for providing a correct delivery address. Delivery times are estimates only; we are not liable for delays caused by carriers, customs, or unforeseen events.

4. Returns, Refunds & Exchanges

Our goal is for every plant to thrive with you. Our full Returns & Exchanges Policy is incorporated into these Terms. Key points include:

• Return Window: 15 days from the date of delivery.
• Condition: Items must be in original, resalable condition with all tags and packaging. A Return Authorisation (RA) number is required.
• Non-Returnable Items: Live plants showing post-delivery stress, personalised/made-to-order items, and items not in original condition (e.g., repotted).
• Refunds: Issued to the original payment method within 14 business days after approval.
• Return Shipping Costs: Borne by the customer unless the return is due to our error (wrong or damaged item).

5. User Obligations & Account Integrity

If you create an account, you are responsible for maintaining its confidentiality and for all activities under it. You agree to:

• Provide true, accurate, and complete information.
• Not use the Site for any fraudulent or illegal purpose.
• Not attempt to interfere with the Site’s operation or security.
• Comply with all applicable import laws and biosecurity regulations for your country. You are responsible for any import duties, taxes, or clearance fees.

6. Intellectual Property

All content on this Site (text, graphics, logos, images, design) is our property or licensed to us and is protected by copyright and trademark laws. You may not reproduce, distribute, or create derivative works from any Site content without our express written permission. The Planters Shop name and logo are our trademarks.

7. Limitation of Liability

To the fullest extent permitted by Australian law:

• We supply plants for domestic, non-commercial gardening purposes. Results depend on your local environment and care.
• We are not liable for any indirect, incidental, or consequential losses (including loss of profit, data, or opportunity) arising from your use of the Site or products.
• Our total liability for any claim related to your order is limited to the purchase price of the relevant product or the cost of re-supply.
• Nothing in these Terms excludes, restricts, or modifies any consumer guarantee, right, or remedy under the Australian Consumer Law (Schedule 2 of the Competition and Consumer Act 2010) or other applicable law which cannot be excluded.

Our goods come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure and for compensation for any other reasonably foreseeable loss or damage.

8. General Provisions

Governing Law: These Terms are governed by the laws of Victoria, Australia. Any disputes shall be subject to the exclusive jurisdiction of the courts of that state.

Changes to Terms: We may update these Terms. The “Last Updated” date at the top will change. Continued use of the Site after changes constitutes acceptance.

Severability: If any part of these Terms is found invalid, the remainder continues in full force.
